Key Changes in the Skilled Immigration Act

We are excited to share some key immigration updates with you, which will start coming into effect from November 18, 2023. These updates might be significant for your future hiring strategy and potential  financial planning for the upcoming year, 2024.

EU Blue Card 

Lowered Salary Thresholds: The EU Blue Card's salary thresholds are being adjusted to make it more accessible for skilled workers:

For "Bottleneck Professions," a minimum salary of 45.3% of the annual contribution assessment ceiling for pension insurance (in 2023: €39,682.80) will now apply.

For "Regular Occupations," a minimum salary of 50% of the annual contribution assessment ceiling for pension insurance (in 2023: around €43,800) will be required.

Please note that these figures are subject to change once again at the beginning of 2024 in January, in line with the standard annual adjustment and a slight increase is expected. 

Bottleneck Professions: The official bottleneck professions list will be expanded, offering more skilled workers the opportunity to apply for the EU Blue Card. See list.

Expanded Eligibility: Recent university graduates and IT specialists will now be eligible to apply for the EU Blue Card, even without a university degree. 
Short-term and long-term mobility: EU Blue Card holders from other EU Member States will benefit from short-term and long-term mobility in Germany, allowing them to visit for up to 90 days and engage in business activities related to their employment. After 12 months of stay in Germany with an EU Blue Card in another EU country, they can achieve long-term residence in Germany without needing a visa.

Residence Permit Changes: Removing the Qualification-Employment Link
Previously, individuals with vocational or university qualifications were often bound to work within their specific field. However, this restriction is now lifted for non-regulated professions. Skilled workers with these qualifications gain the freedom to pursue roles unrelated to their educational background, offering increased job flexibility. This change predominantly benefits skilled workers in non-regulated professions.
